That night, after flirting and drinking together, Clemens whisked McCready away on his boat, eventually winding up at the Sheraton in downtown Fort Myers. According to a close confidant, McCready said they had sex together for the first time that night. If so, she was 17 and Clemens was 30. Based on Florida Statute Section 794.05, which states that “a person 24 years of age or older who engages in sexual activity with a person 16 or 17 years of age commits a felony of the second degree,” their assignation constituted statutory rape. Clemens could have faced up to 30 years in a state penitentiary.
